HMO Management
A breach of these Management Regulations is a criminal offence and fines for these offences are now unlimited.
The received wisdom is that standard (“vanilla”) property management is reactive, whereas HMO Management must be proactive, if management of a HMO is to be legally bulletproof. Regular inspections must take place, logging and checking items on the Regulations, such as the notices, the fire exits, the alarms. Any problems must be solved as soon as possible and all communications should be in writing and recorded. Repairs must be actioned on time.
Generally speaking, the person who “has control” over a property is the person who collects the rent and the person “managing” the property is the person who receives the rent.
If you collect rent from a HMO, you are potentially liable for some HMO offences, such as failing to obtain a licence for a licensable HMO, and for any HHSRS failings.
If you are not named on the HMO Licence and you are not collecting rent, then no liability is made out under the Housing Act 2004.
